Income Tax Notice Over 54 Lakh Cash Deposit Cancelled as ITAT Delhi Relieves Property Dealer

The Income Tax Appellate Tribunal Delhi bench has ruled in favor of a Rohtak-based property dealer, clearing a substantial tax demand levied by the revenue department over cash deposits totaling fifty-four lakh rupees in his personal bank account. The assessment proceedings originated after financial intelligence flagged the high-value cash transactions conducted during the relevant financial year. Because the taxpayer had not filed an income tax return for the period and failed to respond to initial statutory notices issued under Section 148 and Section 142(1), assessing authorities treated the entire cash deposit as unexplained income and added the amount directly to his taxable base.

The taxpayer subsequently challenged the assessment order before the Commissioner of Income Tax Appeals, who dismissed the plea and upheld the addition. Seeking legal remedy, the taxpayer appealed before the appellate tribunal, represented by authorized counsel. During tribunal proceedings, legal counsel submitted comprehensive documentary evidence establishing that the taxpayer operated exclusively as a commercial intermediary between property buyers and the primary seller family. The defense presented detailed bank account statements, official land sale deeds, and signed affidavits from both property sellers and buyers confirming that cash amounts were handed over specifically for onward transfer during property registrations.

Upon evaluating the submitted documentary records, the tribunal bench comprising judicial and accountant members observed that the cash flow represented a temporary pass-through mechanism rather than personal income. The bench noted that the direct linkage between buyer payments, bank deposits, and subsequent transfers to land sellers provided clear proof of intermediary function. Consequently, the tribunal set aside the earlier assessment order and appellate rulings, deleting the addition of fifty-four lakh rupees along with the associated tax demand.

Tax professionals evaluating the judgment highlighted that while the tribunal provided complete relief to the intermediary, the validated transaction trail establishes clear evidence of land sale consideration accruing to the sellers. Legal experts noted that tax authorities may utilize these confirmed transaction records to verify whether the underlying capital gains were appropriately disclosed and taxed in the hands of the ultimate property sellers.
